According to FINRA, Maryellen Smyth was barred from association with any FINRA member firm in all capacities after refusing to appear for on-the-record testimony.

FINRA was investigating whether Smyth participated in misconduct by employees of her member firm involving insurance continuing education requirements. Continuing education requirements exist to ensure that financial professionals maintain current knowledge and competency in their fields.

As part of its investigation, FINRA requested that Smyth provide testimony. Under FINRA Rule 8210, all associated persons must cooperate with FINRA investigations, including appearing for testimony when requested. This cooperation requirement is fundamental to FINRA's ability to investigate potential violations and protect investors.

By refusing to appear and testify, Smyth obstructed FINRA's investigation into potential misconduct involving continuing education requirements. As a result, FINRA imposed a bar, permanently prohibiting Smyth from working in any capacity at a FINRA member firm.

This case is one of several in January 2025 involving representatives barred for refusing to testify. The pattern underscores FINRA's commitment to enforcing cooperation requirements. Investors should understand that when representatives refuse to cooperate with investigations, the resulting bars serve to remove potentially problematic individuals from the industry, even if the underlying allegations are never fully resolved.
