Arcview Capital Fined $25,000 for Net Capital Violations

fined $25,000

According to FINRA, Arcview Capital, LLC was sanctioned for conducting a securities business while failing to maintain required minimum net capital and for failing to timely notify regulators of these deficiencies.

The firm conducted securities business on 43 days while its net capital fell below the required minimum of $5,000, with deficiencies ranging from $27,914 to $105,137. These shortfalls resulted from excessive expenditures. Despite having a regulatory obligation to immediately notify FINRA and the SEC of net capital deficiencies, Arcview filed notifications between three and 44 days late for 46 separate deficiencies.

The firm's written supervisory procedures were also found to be inadequate, providing no guidance on suspending business operations during a net capital deficiency and lacking a reasonable process to ensure timely filing of deficiency notices.

Net capital requirements serve as a critical safeguard for investors, ensuring that broker-dealers maintain sufficient liquid assets to meet their obligations to customers. When firms operate below minimum net capital, they may lack the resources to properly protect customer assets or fulfill their financial commitments. The repeated nature of Arcview's violations—operating below required capital on 43 separate days—demonstrates a systemic failure to maintain adequate financial resources. For investors, this case underscores the importance of choosing firms that maintain strong financial positions and comply with regulatory capital requirements designed to protect customer assets.
