Avenue Securities Fined $300,000 for Misleading Influencer Marketing

According to FINRA, Avenue Securities LLC has been censured, fined $300,000, and required to certify remediation for violations related to social media influencer marketing targeting Brazilian investors.

The firm's affiliate arranged for influencers to promote the firm through social media platforms, paying them monthly fees for promotional content. However, the influencers' communications were not fair and balanced and made misleading claims.

Some posts suggested that investments in certain securities would guarantee dividend income without disclosing inherent risks. Influencers promoted investment in U.S. markets with promises of investment success and used hashtags suggesting investors would get wealthy. Posts promoting crypto assets failed to explain risks, including that investors could lose their entire investment.

Some influencers described the firm as "free" or "zero fee" without disclosing that certain fees may apply. Many posts failed to clearly identify the communications as paid advertisements.

The firm failed to have a registered principal review and approve the influencer content prior to posting and did not maintain records of these communications. The firm's procedures did not provide guidance about when influencer communications were retail communications requiring firm oversight.

This case highlights the risks of social media investment advice. Investors should be skeptical of promotional content and understand that paid influencers may not provide balanced information about investment risks.
