George Ndifor Jing Barred for Refusing to Cooperate with Investigation

According to FINRA, George Ndifor Jing was barred from association with any FINRA member in all capacities for refusing to provide documents and information requested by FINRA.

FINRA's investigation focused on whether Jing participated in an undisclosed outside business activity (OBA) or private securities transactions. Both of these activities, if conducted without proper disclosure, represent serious violations of securities regulations.

Outside business activities must be disclosed to a broker's member firm so the firm can evaluate potential conflicts of interest and determine whether the activity could interfere with the broker's responsibilities to customers. Private securities transactions, sometimes called "selling away," involve a broker participating in securities transactions outside the scope of their employment with their member firm.

Private securities transactions are particularly concerning because they often occur without the firm's supervision, leaving investors without the protections that regulatory oversight provides. These transactions have been associated with numerous investor frauds and Ponzi schemes.

Jing's refusal to provide requested documents and information resulted in his permanent bar from the industry. Without his cooperation, FINRA could not determine the nature and extent of any undisclosed activities or assess potential harm to investors.

For investors, this case highlights the risks associated with investment opportunities that come from your broker but are not offered through their firm. If a broker recommends an investment that seems outside normal channels, ask whether the investment is offered through and supervised by the broker's firm. Be especially cautious of investments described as exclusive opportunities or that promise unusually high returns.

Always verify that investments are properly registered and that your broker is authorized to sell them.
