Harold Edward Klein Suspended for Falsifying Customer Signatures
According to FINRA, Harold Edward Klein was fined $5,000 and suspended from association with any FINRA member in all capacities for three months on October 15, 2024. Klein caused his member firm to maintain inaccurate books and records by falsifying the electronic signatures of 58 customers, 46 of whom were seniors, on account documents. The documents signed by Klein included account applications, account feature forms, and account transfer forms, all of which were required books and records of the firm. None of the customers complained and the transactions were authorized. Klein also incorrectly attested to the firm on compliance questionnaires that he had not signed or affixed another person's signature on a document. The scale of this violation is significant—58 falsified signatures shows a systematic pattern rather than isolated incidents. The fact that 46 of the 58 customers (nearly 80 percent) were seniors is particularly concerning. This suggests Klein may have targeted vulnerable senior investors who might be less likely to detect or question the forgeries. Even though customers authorized the underlying transactions and did not complain, the falsification of signatures is still a serious violation. Signature requirements exist to create proper documentation and prevent fraud. When brokers falsify signatures, they create false records and eliminate important safeguards. The false compliance attestations demonstrate that Klein knew he was violating firm policy but actively concealed his misconduct from supervisors. This shows dishonesty beyond the original forgery violations. Investors should never allow anyone to sign documents on their behalf, regardless of convenience. Every signature should be made personally to ensure proper documentation and prevent situations where unauthorized signatures might be created in the future. The three-month suspension from November 4, 2024, through February 3, 2025, reflects the seriousness and scale of Klein's violations.
