Jose Abel Gamez Barred for Refusing to Cooperate with Investigation
According to FINRA, Jose Abel Gamez was barred from association with any FINRA member in all capacities for failing to provide information and documents requested by FINRA.
FINRA's request was issued in connection with its investigation into whether Gamez used customer funds for personal reasons. This allegation, if proven, would constitute conversion of customer assets, one of the most serious violations in the securities industry.
Conversion occurs when a broker misappropriates customer funds or securities for their own use. This can take various forms, including unauthorized withdrawals, forging customer signatures on documents, or redirecting customer funds to the broker's personal accounts or creditors.
Gamez's refusal to cooperate with FINRA's investigation resulted in his permanent bar from the securities industry. Without Gamez's cooperation, FINRA could not fully investigate the allegations or determine the extent of any customer harm.
For investors, this case serves as an important reminder about protecting your assets. Monitor your account statements regularly and verify that all transactions and withdrawals were authorized. Be wary of any broker who requests that you make checks payable to them personally rather than to the brokerage firm. Never give a broker discretionary authority over your account without careful consideration.
If you suspect that a broker has misused your funds, act quickly. Report the suspected misconduct to the firm's compliance department, file a complaint with FINRA, and consider consulting with a securities attorney. You may be able to recover losses through FINRA arbitration or other legal proceedings.
You can verify the registration status and disciplinary history of any broker through FINRA's BrokerCheck system at brokercheck.finra.org.
