Kittiany Davis Barrios Barred for Refusing to Cooperate with Customer Complaint Investigation
According to FINRA, Kittiany Davis Barrios was barred from association with any FINRA member in all capacities on October 17, 2024, after refusing to provide documents and information or to appear for on-the-record testimony requested by FINRA in connection with an investigation.
The investigation originated from receipt of a FINRA Rule 4530(f) filing made by Davis Barrios' member firm that disclosed a civil complaint filed by a firm customer against the firm. FINRA Rule 4530 requires firms to report customer complaints that meet certain thresholds, and these filings often trigger FINRA investigations to determine whether there was misconduct and whether other customers may have been affected.
Although Davis Barrios initially cooperated with FINRA's investigation, she ultimately ceased doing so. This pattern—initial cooperation followed by refusal to continue—often occurs when an investigation uncovers information that the individual finds difficult to explain or when requests for additional information would require the individual to produce incriminating evidence.
