Pinnacle Investments Fined for NT-ETP Supervision and Branch Inspection Failures
According to FINRA, Pinnacle Investments, LLC was censured, fined $65,000, and ordered to pay $53,847.99 plus interest in restitution to customers for multiple supervisory failures including inadequate oversight of non-traditional exchange traded products (NT-ETPs) and failure to conduct required branch inspections.
The East Syracuse, New York firm's written supervisory procedures and training regarding NT-ETPs did not address Regulation Best Interest as it applied to these complex products. While the firm required representatives to sign attestations acknowledging the risks of holding NT-ETPs for more than a single trading session, it did not confirm that representatives actually understood these features and risks.
The firm's supervisory review of NT-ETP recommendations was limited to verifying that representatives had signed the attestation, without any assessment of whether the intended holding periods were in customers' best interest. As a result, the firm failed to identify that a representative was recommending customers buy and hold NT-ETPs for durations that were not in their best interest, causing $53,847.99 in realized losses.
Additionally, the firm's supervisory system was not reasonably designed to detect discretionary or unauthorized trading. The firm relied exclusively on manual reviews of trade blotters that failed to detect red flags such as multiple unrelated customers purchasing the same security on the same day. When the firm attempted to implement an automated monitoring system, technical issues rendered it ineffective.
The firm also failed to conduct timely inspections of six branch offices and one Office of Supervisory Jurisdiction. Between 2016 and 2021, the firm was unable to provide records demonstrating it had inspected these locations within the required timeframes.
For investors, NT-ETPs including leveraged and inverse funds are designed for short-term trading and can produce significant losses when held longer. Ensure you understand any complex product before investing.
