Tori Uhiren Barred for Refusing to Provide Information to FINRA

According to FINRA, Tori K. Uhiren (also known as Tori van der Geest) was barred from association with any FINRA member in all capacities for refusing to provide documents and information requested by FINRA in connection with its investigation into potential violations outlined in a Form U5 filed by her member firm.

The Form U5 filed by Uhiren's firm stated that she was permitted to resign and disclosed that the firm's internal review concluded that she failed to supervise daily operations and team members in the firm's office. FINRA initiated an investigation into these potential supervisory failures and requested documents and information from Uhiren. However, she refused to provide the requested materials.

The duty to cooperate with FINRA investigations is a fundamental obligation of all registered persons. This requirement exists to enable FINRA to effectively investigate potential misconduct and protect investors. When individuals refuse to cooperate with investigations, it prevents FINRA from determining the facts and taking appropriate regulatory action. Refusal to cooperate is treated as one of the most serious violations because it obstructs the regulatory process.

Supervisory failures can have serious consequences for investors, as inadequate supervision may allow unsuitable recommendations, unauthorized trading, or other harmful conduct to occur. When a registered person refuses to provide information about potential supervisory failures, it raises concerns about what they may be attempting to hide. This case reinforces that cooperation with regulatory investigations is mandatory, and refusal will result in a permanent bar from the securities industry.
